Wills, Inheritance Tax Planning and Probate

At D’Angibau Solicitors we understand that providing for the future and the making of a will can be very emotional and many people put off making a will for this reason and because they assume that everything they own will be passed on automatically to their next of kin. Sadly this is not always the case and we would like to stress the importance of making a will.  We have a caring and understanding team who are able to provide practical and sensible advice with care and sensitivity.

In addition to wills we can help you with:
  • Inheritance tax planning
  • Lasting Power of Attorney
  • Probate and administration of estates
  • Trust administration
Why we recommend that you should make a Will, even if you do not own a house…
  • Without a Will you will not appoint executors of your choice
  • Without a Will the Estate may be taken by people you do not want to benefit – this is called dying “Intestate”
  • In a Will you can appoint guardians for your children
  • In a Will you can make various bequests of your personal items to people of your choice
  • Only with a Will can you make maximum use of inheritance tax exemptions
  • Obtaining a grant of probate is normally quicker and cheaper with a Will
  • A Will can be changed easily and quickly at any time

If you have not made a Will (or need to bring one up-to-date) please contact one of our offices.

Probate

Dealing with someone’s estate can be very onerous and time consuming.

We can…

  • Assist Executors in the administration of the Estate
  • Prepare the application for probate (when there is a Will) or letters of administration (when there is no Will)
  • Help with life policies, shares, savings and investments
  • Advise on taxation problems
  • Complete all Inland Revenue returns
  • Act on the sale of any property
  • Distribute the Estate after administration has been completed

We can also…

  • Act as Trustees for continuing trusts (e.g. for children)
  • Advise on Powers of Attorney when clients need help managing their affairs
  • Deal with an application to the Court of Protection when someone is sick or infirm but their affairs need to be dealt with.
  • Set up trusts for specific purposes (eg to reduce inheritance tax liability)

Taxation

It is most important that clients with property or savings make full use of all available tax exemptions in arranging their affairs.

Considerable savings can be made if professional advice is taken before decisions on these matters are made.

We can offer advice on…

  • Inheritance tax and capital gains tax planning
  • Income tax planning and tax returns
  • Living Wills
  • Lasting Powers of Attorney
  • Appointment of Deputies

Where clients have accountants and other financial
advisors we will always be happy to liaise with them and advise jointly on relevant problems.
