Section 21 Housing Act

All Tenancy Agreements created after 28th February 1997 are Assured Shorthold Tenancy Agreements unless the parties have agreed otherwise.

Providing a Notice has been served upon the Tenant of at least 2 months in duration, which Notice complies with Section 21 of The Housing Act 1988 (As Amended) you are entitled to an Order for possession. You do not need to attend Court.

Our Cost - £350.00

For this we will:

  1. Draft and arrange for service Notice compliant with Section 21 of the Housing Act 1988.
  2. Draft and issue at Court the Claim Form if the tenant has not vacated.
  3. Obtain an Order For Possession.
  4. Advise you with regard to Enforcement.

Possession - Arrears of Rent

In certain circumstances it may be preferable to seek an Order For Possession relying upon grounds set out in Schedule 2 of the Housing Act 1988 being non payment of rent.

The Notice to be served upon the tenant need only give 2 weeks to vacate. However that Notice is in a prescribed form and deviation from it may cause the claim to be refused by the Court.

If successful, however, the Court may grant Judgement for arrears of rent as well as an Order For Possession.

Our Costs - £500.00

For this we will:

  1. Draft and arrange for service the prescribed Notice seeking possession.
  2. Draft and issue at Court a Claim Form.
  3. Prepare your evidence.
  4. Arrange for representation at Court by a suitably qualified Advocate.
  5. Advise you further with regard to Enforcement

Other grounds for possession are also set out in Schedule 2 of The Housing Act 1988. We will advise you as to whether any of them are appropriate and if so agree with you our costs in advance.
