Landlord Possession Enforcement

Often, Tenants will not vacate premises even after a Court Order has been made. The Tenant in such case continues to enjoy the protection of the Law.

The Possession Order can be enforced, by obtaining a warrant from the Court. Enforcement by any other means may result in a prosecution under The Protection From Eviction Act. We will obtain a warrant for possession on a fixed cost of £60.00.

Enforcement of Money Judgement

If you have a Money Judgement whether as part of a Possession Order or as a result of separate proceedings you may take enforcement action against the debtor in the event of non-payment.

At D’Angibau, we will advise you as to the most appropriate course of action but the following are available:

Oral Examination
The debtor will be required to attend Court and give full details of his assets and liabilities to enable you to select the most appropriate means of enforcement.

Charging Order
If the debtor owns property the Judgement Debt may be secured against that property until such times as the Judgement Debt is satisfied.

Third Party Debt Order
If a third party owes money to the Judgement Debtor (including a Bank or Building Society), you may obtain an Order that that person or organisation pay you those funds.

Warrant of Execution
The Bailiff will be instructed to seize goods to the value of the Judgement Debt.

Bankruptcy/Winding Up
You may rely upon the Judgement Debt in bringing Bankruptcy proceedings on the case of a Limited Company winding up.

We will provide you with a separate cost estimate bringing insolvency proceedings but we will limit our costs for service of a Statutory Demand as a first step to £60.00.
