Lasting Power of Attorney
We all hope to be in control of our mental and physical faculties until the very last moment. Often, however, things don’t turn out that way.
Some of us may suffer injury or accidents before we grow old, and many of us will develop illness as we grow older. Having someone you trust to look after your finances is essential in that case, and most of us would want some control over who that someone is and what they can do. The trouble is – if you don’t appoint them now it may be too late to appoint them later on after you have become ill.
The Lasting Power of Attorney allows you to appoint someone you trust while you are still in good health, who can look after your property and affairs and even your general welfare after you become incapable. It is important not to think you will only need this when you reach old age, because serious accidents can occur at any time.
Making a Lasting Power of Attorney can be a little time consuming and expensive and for that reason many people put it off. Next to a Will, however, the LPA is one of the most important documents you will ever need, and the effort is worthwhile now, if you want to avoid real problems and the involvement of the Court in your affairs later on.
You do not necessarily need a Solicitor to complete a Lasting Power of Attorney, but it is a powerful and important document and we would always recommend that you be properly and professionally advised before granting one. Legal costs will typically be of the order of between £500 - £1,000 and there is a Court registration fee of £150 before the Power can be used.
